As a user or customer of the WEBUYGOLD.COM website and its services the terms and conditions below are legally binding and vests to the benefit of Webuygold.com, it’s Affiliates, its Proprietors and its successors and assigns.

The Requirements For Use Of Our Service:

Every customer who conducts business, sends precious metals, jewelry, and other property to us certifies that they are at least Eighteen (18) years of age. In addition every customer represents and warrants that they are the actual legal owner of any and all precious metals, jewelry, and other property offered or sold to us. The customer also certifies that they have the right to sell or transfer any of the items, and that there are no claims, liens, or encumbrances on any of the items being sold or transferred. In addition, every customer certifies that they are the legal owner of their merchandise, acting on his or her own behalf and not acting as the agent or representative of another person.

We may, but shall not be obligated or required to, request documentation or other proof of compliance with the requirements contained in these terms and conditions. You also agree that you have provided us the email address, physical address, and telephone number that are in our records, and it is your responsibility to provide us with any current or updated contact information in future transactions. You further agree that any email message that we may send to you is deemed to have been effectively received by you and constitutes due notice to you for any purpose required in these Terms and Conditions.

By proceeding and agreeing to the Terms & Conditions of your transaction, your agreement will act as an electronic signature certifying that you have met the age requirements listed above and certify that your are the rightful owner of your items. It will also certify that the information you have provided to us is correct. This disclosure and consent follows Section 101(c) of the U.S. Electronic Signatures in Global and National Commerce Act (“E-SIGN”), codified at 15 U.S.C. Section 7001 et seq.

Rightful Possession:

Our policy is to ascertain by reasonable inquiry your legal right to posses and dispose of any items or merchandise you offer or send to us. By using our service you certify that you are in rightful and legal possession of your items or merchandise and that you have the right to sell it and transfer its title. You also certify that all items and merchandise have no claims, liens, or encumbrances on any of the items or merchandise being sold or transferred.

Receipt and Processing of Your Items:

Webuygold.com operates as an internet drop off store as defined by the laws of the State of New Jersey, where we are licensed to do business. All transactions are conducted through direct mail or other means of shipping. We do not physically transact business for the internet service offered through our website at that physical location. By sending us your items, you authorize or consign us to purchase your items at the values we have listed on our website.

PROTECT YOUR MAIL SHIPMENT AGAINST LOSS OR DAMAGE WITH INSURANCE PURCHASED THROUGH THE UNITED STATES POSTAL SERVICE:

Remember, you are responsible for insuring the items you ship to us.

We have found that the safest and most secure way to send your merchandise to us is to use The United States Postal Service (USPS). By mailing your items to us using the USPS you have full control over the value of insurance placed on your items.

While many companies offer free mailing kits, your items are generally insured for $100.00 or less. Why risk an unexpected loss when you can send your items fully insured through the United States Post Office. If your package is lost, damaged, or rifled you can deal directly with the United States Postal Service for a quick and speedy claim.

You have several options for adding security to the items or merchandise you send to us for processing.

Security is key when you?re sending valuables through the mail. Whether you are sending precious metals, jewelry, gems or antiques, getting insurance provides that security. Insure your package only for what its contents are worth; you?re only covered for the actual value at the time and place of mailing. Ask your Postal Clerk for the forms required to insure your shipment. The USPS offers a large selection of FREE POSTAL SHIPPING BOXES when you use PRIORITY MAIL and EXPRESS MAIL. Just ask the Postal Clerk for the FREE BOXES.

Remember, you are responsible for insuring the items you ship to us.

The insurance charges are very reasonable when you use the United States Postal Service. The Postal clerk will be glad to assist you with preparing, shipping, and insuring your items.

By using the USPS Insurance option the basic USPS Insurance Policy provides up to $5,000 indemnity coverage for a lost, rifled, or damaged article.

For items of greater value requiring additional insurance, try Registered Mail which covers up to $25,000. Registered Mail can be used with First-class Mail® and Priority Mail®.

Registered Mail Provides The Maximum Security:

When you’re sending valuable or irreplaceable items through the mail, protect them with Registered Mail?.

Items you send with Registered Mail are placed under tight security from the point of mailing to the point of delivery, and insured up to $25,000 against loss or damage. And you can verify the date and time of delivery and the delivery attempts online.

Registered Mail? requires a completed insurance form which can be found at any United States Post Office.

Limitations On Insurance Liability of Items Returned To You:

On certain occasions items sent to us may have to be returned to you. We will insure the item or items returned to you for two (2) times the value we set on the item or items. It is our sole discretion to determine the value of the item or items regardless of the amount the item or items were insured for when sent to us. It is our obligation to determine a fair value so we can properly insure your returned item or items. It is our sole discretion to choose the return mail carrier, insurance coverage, and package receipt verification of our choice. We will have no liability whatsoever related to the return of any item or items returned to you except for such insurance obligation. Our favorite choice of shipping carriers is The United States Postal Service and their insurance coverage.

Items And Valuables Not Claimed For Over Six Months (180 Days):

In the event that we are not able to contact you, from the information you supplied to us when you sent us your package, and your item and or items go unclaimed, we shall not be liable for any damages to any person or Corporation with regards to items or valuables unclaimed for a period of over (6) six months or 180 days from the date of receipt. It is the customers sole responsibility to claim their items within this time frame. We will make every attempt to contact you to complete the transaction. This is why it is very important to provide us with the correct information when you are sending us your package.

Verbal Offers:

Any customer or prospective seller may request us to provide a telephone or e-mail quote for your items after such items have arrived at our processing facility. Requests must be made in writting and be included with your shipment and your customer information sheet. Verbal offers may, at our discretion be recorded. Upon a verbal acceptance of our offer from a telephone or e-mail quote, payment will be issued by us within twenty four (24) hours of such acceptance, and the ten (10) day customer satisfaction holding period guaranty will no longer be applicable to such transaction.

Foreign Usage:

We make no representation that the usage of this site, or the content provided herein, will not violate the laws of your local jurisdiction. You are responsible for the laws of your jurisdiction, especially if you are accessing this site from outside the United States of America (U.S.A.).

MATERIALS NOT TO BE MAILED TO US:

You agree not to send in materials containing the following: Arsenic, Beryllium, Bismuth, Cadmium, Mercury, Nickel, Lead, Antimony, Selenium, Tin, Tellurium or any other deleterious elements.

Precious Metals Testing:

In order to determine the correct Karat or Purity of a Precious Metal, we have to chemically test the piece. This sometimes requires making filings or incisions into the piece. In some cases the piece may require deep cuts to determine the purity of its core. This allows us to determine the authenticity and purity of the piece. By shipping us your items or items you authorize us to test these pieces to determine the purity of your items. You understand that this testing process may leave filing or incision marks. We are not responsible for correcting or repairing testing marks.

Weights & Measures:

As required in accordance to government regulations the scales we use are Legal For Trade and are calibrated, tested, and licensed by the State of New Jersey. As a result, the weights determined by our processing agents are final.

Gemstone Policy:

Gemstones can be Genuine or Synthetic. Often you may not have the proper tools to remove gemstones with little or no value from your jewelry. You may also be unsure if your gemstones in your jewelry have significant value. A majority of these gemstones are often synthetic or have little or no value to us. It is not our policy to purchase gemstones. If you send us Precious Metals containing gemstones and we determined if any of these gemstones are of value to us, a value will be determined by one of our appraisers and a payment will be made to you. This value will be included in your total payment. By sending us jewelry which contains gemstones you authorize us to determine if the gemstones are of value to us. Gemstones with little or no value will be discarded. Gemstones often have to be removed from jewelry pieces to determine the correct Precious Metals weight of those pieces. You authorize us to remove gemstones to determine a more precise Precious Metals weight. You understand that there may be some cutting and disassembly involved in this process. We are not responsible for reassembly of these jewelry pieces.

Non Precious Metals:

We do not purchase items which do not contain Precious Metals. If you send a shipment containing Precious Metals mixed with Non Precious Metals you will be paid the Precious Metals buying rate for your Precious Metals. Non Precious Metals will be separated by our Precious Metals evaluator. If found in your shipment, the Non Precious Metals will be given a value, if they are of value to us, as determined by our appraiser and a payment will be made to you. This value will be noted as Non Precious Metals or Other Metals. We reserve the right to return the Non Precious Metals to you if determined to be of little or no value to us. We also reserve the right to dispose of these Non Precious Metals if it is determined that these items have little or no value to us. Please read LIMITATIONS ON Insurance LIABILITY OF ITEMS RETURNED TO YOU in the Terms and Conditions.

Time Line For Payment:

Once your items have been received by us they will be transferred to our evaluation department. When a Precious Metals evaluator receives your shipment your items will be assessed and a check will be sent out to you within 48 hours of such assessment. In the event the 48 hour period would extend into a weekend or holiday, your items will be processed and a check issued the first business day following the holiday or weekend. The 48 hour period does not include the time it takes for your check to be delivered to you. With the recent increase in shipments to us, your shipment will usually reach one of our Precious Metals evaluators within 48 hours of its arrival at our processing center. Large quantities or unusual forms of any metal may require an assay and may delay the processing time. In our discretion, with or without notice, we reserve the right to suspend or extend any time frame listed or specified if we encounter technical difficulties with our website, encounter any delays caused by Force Majeure, or require additional time in order to comply with any applicable federal, state, or local law, ordinance, or regulation.

Methods of Payment:

All of our buying prices are clearly posted on our Market Value Page. Unlike other websites, which do not update their buying prices, we are constantly reviewing current market prices to offer you our most current and up to date buying prices. We offer you at no charge an Express Processing Payment Service or EPPS. By using our EPPS your payment will be mailed to you insured with a tracking feature using USPS Express Mail in most cases. By using this service, and knowing our displayed buying prices, which we have posted, you waive the customer satisfaction period. This allows us to lock in your selling price to the fixed market value on the day that your shipment is processed. By using our regular processing service your payment may not be USPS Express Mailed and may take several days to arrive. You may request us to provide a telephone or e-mail quote for your shipment after such shipment arrives at our processing facility. Upon a verbal acceptance by you via telephone, which may at the discretion of Webuygold.com be recorded, or return acceptance via e-mail of our quote, your payment will be issued by us within (48) forty eight hours of such acceptance and the customer satisfaction period will no longer be applicable to such transaction.

If a check for your payment is lost we must be notified. We will issue a stop payment order on the lost check with our bank. A replacement check will be reissued after 15 days from when the stop payment order was placed with our bank. If the lost check is found before the 15 period you can return the check to us and a new check will be reissued immediately.

Customer Satisfaction Period:

If you find a discrepancy in the prices we have posted and the prices you received, we offer a customer satisfaction period. First review our listed prices on our website and then compare them to your receipt. Remember factors can vary slightly +/- but are usually to the customers advantage. If you find that there is a verifiable difference from the posted prices and the prices you received call us or e-mail us. If you provide proper proof of a discrepancy and confirm it with our representative within (48) forty eight hours of your receipt of payment, you will be issued a confirmation number. If in agreement an additional check will be issued for the discrepancy to correct the difference. Remember we are buying your Precious Metals for their Precious Metals Value. Please refer to the Precious Metals Testing and Gemstone Policy sections so you understand that your items may not be in their original condition and may be rendered unusable after processing the items to determine their Precious Metals Value.

These charts are prepared and provided by third parties other than us, and we include such charts only for general information to you, our customers and viewers of this website. We shall not be liable to anyone who relies on the information contained within these charts. This website may contain typographical errors or mistakes, and we disclaim any responsibility for such errors and you agree to hold us harmless from any legal responsibility for such errors.

Disputes And Applicable Law:

We shall not be liable to any person or corporation for any damages whatsoever, including without limitation, any direct indirect, consequential, compensatory, punitive, business loss or interruption damages arising from your use of or inability to use materials and information in this website. This provision applies even if we have been advised of the possibility of such damages.

Any dispute arising out of or relating to the use of this website shall be conclusively resolved by arbitration in the State of New Jersey under the commercial arbitration rules of the American Arbitration Association then existing, and any judgment on the arbitration award may be entered in any court having jurisdiction over the subject matter of the controversy.
